Privacy Policy for POVer

1. Scope of Service

POVer provides a platform for event organizers ("Hosts") and participants ("Guests") to collect and share photos in a unified album via QR codes and links. Our Service is designed to work without mandatory app installation, utilizing browser-based technology and App Photos and videos for events such as weddings, parties, and corporate gatherings.

2. Information We Collect & How We Use It

We collect information strictly necessary to provide and improve our core Service:

• User Content (Photos & Videos): To provide our core functionality (shared event albums), we require access to your device's camera and/or photo library. Images, videos, and associated metadata (such as timestamps for sorting) are uploaded solely to facilitate the event album experience.
• User-Provided Information: Names, phone numbers, profile pictures, and email addresses used for account creation, event management, and communication.
• Automatic Data Collection: Technical data (IP addresses, device types) collected via cookies and third-party services, including Firebase (tracking and analytics), Sentry (crash reporting), and AppsFlyer (Mobile Measurement Partner) to ensure app stability and monitor performance.

3. Data Ownership, Processing, and Storage

• Ownership & License: All photos and videos remain the exclusive property of the user who uploaded them. By uploading, you grant POVer a limited, worldwide, royalty-free license to host, process (e.g., generate thumbnails, compress videos), and display this content strictly and solely to provide the Service for your specific event.
• Strict Privacy Guarantee: We do not sell your photos or videos. We do not use your personal event media for our own marketing or advertising purposes without your explicit, separate written consent. We do not use your media to train AI models.
• Data Retention & Deletion: We act as a temporary sharing platform. Media is stored securely on our cloud infrastructure only for the duration of the event's lifecycle. Event Hosts can delete the entire album or specific media at any time, which will permanently remove the content from our active servers.

4. How We Share Your Information

• With Event Participants: Photos and videos you upload are visible to the Event Host and anyone who has the specific QR code or link to that event album.
• With Service Providers: We share data with trusted third-party vendors (like cloud hosting providers, Firebase, Sentry, AppsFlyer) strictly under data processing agreements to operate, secure, and analyze our Service.
• Legal Requirements: We may disclose information if required to do so by law or in response to valid requests by public authorities.

5. Prohibited Content and Conduct

Users are strictly prohibited from uploading any content that is:

• Illegal, sexually explicit, pornographic, or violent.
• Harassing, defamatory, or infringing on the intellectual property or privacy rights of others.
• Deemed inappropriate or harmful by community standards. POVer reserves the right (but not the obligation) to remove any content at its sole discretion, without notice and without liability, if it violates these standards.

6. Technical Safeguards and Limitations

• Service Availability: POVer is provided on an "as-is" and "as-available" basis. We do not guarantee that the Service will be uninterrupted or error-free.
• Data Loss: POVer is not liable for the loss, deletion, or corruption of any data caused by software bugs, server outages, browser crashes, or network timeouts. Users are responsible for their own backups.

7. Disclaimer of Third-Party Content (The "Passive Conduit" Clause)

POVer acts as a neutral, passive venue for user-generated content.

• No Responsibility for Uploads: We do not pre-screen all content and are not responsible or liable for any content shared in the app - including but not limited to offensive, harmful, inaccurate, or illegal photos/comments - uploaded by Guests or Hosts.
• No Editorial Control: Any views or content expressed within an event album belong solely to the uploader and do not reflect the views of POVer.

8. Limitation of Liability

To the maximum extent permitted by law, POVer and its founders shall not be liable for:

• Any indirect, incidental, or consequential damages (e.g., emotional distress due to lost photos or unexpected content).
• Security breaches or unauthorized access to data ("leaks") beyond our commercially reasonable control. Our total liability is strictly limited to the amount paid by the user for the specific event service.

9. Host & Guest Responsibility

• Host as Moderator: The Event Host is the primary moderator and assumes full legal responsibility for the content within their album.
• Indemnification: You agree to indemnify and hold POVer harmless from any claims, damages, or legal fees arising from the content you upload or your violation of these terms.

10. International Transfers & Changes

Our Service uses global cloud infrastructure. By using POVer, you consent to data processing in jurisdictions where our servers operate. We may update this policy periodically; continued use constitutes acceptance.
